There is no way WICB would pay this. They have no money !!

Interestingly BCCI claims to have suffered a blow of upto $255 mil from WI withdrawing from this tour.

If this bloated figure is correct, then to be fair to BCCI, asking for a mere $42 mil in comparison (a mere quarter of the actual loss), is being quite considerate of the WICB's present situation.
 
The WICB has't even paid its countrymen yet!
How will they pay $42 million?
The idea of CPL has dented them big time!
 
Bit pointless asking for that much isn't it? Never going to be payed and west indies cricket will simply be reformed.
 
Only thing though, I doubt they could take legal action if the WICB offered to send a replacement team.
 
I think the thing to bear in mind is that if the players weren't prepared to crash a tour then the WICB might simply have carried on ignoring them.

this is pathetic couldnt they have done this after the tour, or in the background, is international cricket a playground for their egos, BCCI should go ahead with taking legal action.

After this farce, BCCI should seek all $255 mil, and not just $42 mil that they have sought. Create a scene, quit a tour and then say days later, its all alright, things have been resolved.

I think the thing to bear in mind is that if the players weren't prepared to crash a tour then the WICB might simply have carried on ignoring them.

im not blaming the players even if they are to fault a bit, but WICB the most, if it was something that they could reach to agreement in a few days, they shouldn't have let the situation deteriorate this much if they could fix it so quickly, it just shows their blatant disregard for others and mismanagement including the players.
 
Obviously BCCI is going to file for damages. Not doing so would be stupid and set a very bad example. It would basically be saying - you can go back on your commitment and we wont point any fingers as long as you have pre-existing financial issues.

Eventually this will be resolved. But this move was necessary

and LOL @ the dispute being resolved on the day the first Test would have ended.
 
Personally don't see how the BCCI could be able to file for damages as the WICB offered to send out a replacement team, therefore it is legally in fact India that broke the tour up?
 
^^Who knows how there bilateral series contracts are signed. You could be right about that. Still incredibly foolish from WICB that they were willing to put effort into providing a replacement team, instead of sorting it out with the players who were currently on tour. Especially since they resolved the issue in less than a week

im sure there would be some contract clause for the quality of player in the squad or contract that bind the squad being sent and im sure bcci wouldnt be making a legal move if they dont have stuff to back it up. especially if its basic stuff we can think of, im sure wicb with its legal panel would be able to think x times more, so bcci wouldnt make a legal claim without a solid case .

From what I've heard recently, although don't take this for definite, all tour contracts must follow a base contract set by the ICC. Apparently this contains no reference to the quality of participating players. I don't see how if it was in a contract you could regulate it anyway. Those are the best currently available cricketers from the WI and no claims could really be made against that.

I dunno, isn't this the same legal panel that claimed the wrong offence again Jimmy Anderson?

nope that was an ICC hearing[a domestic procedure] which was totally biased despite dear bigmouth jimmy accepting his crimes. A legal procedure would have been filing a case in court for manhandling etc.


Legal proceeding will be carried through either courts in india or WI mostly.


From what I've heard recently,

a source would be nice, im pretty sure there are guide lines for the kind of team you can send or the team being sent would be bound by some contracts except for natural causes like injury terror etc.
