I think I'd prefer if the run out law counted the bat as grounded if any part is grounded or if it was within a certain distance from the ground.

A bowler who delivers the ball with the front part of his foot grounded beyond the line without touching it and his heel on the line but in the air gets counted as a fair delivery and this seems reasonably equivalent.
