He might just be scratching his arm or warming up.

I mean Border appears to have seen the event and reacted honestly and said that Harbhajan did nothing so I can't see how he can be charged if he has him and the Indian manager backing him up.

Well, I saw it on the news tonight - they snapped him about five times doing different "monkey gestures", with him scratching his armpits like monkeys do. The amount of times he did it can't be put down to coincidence or to just warming up. He is a clown.
